These terms, and who they bind
These Terms of Use govern your use of the DayOne website at dayone.build, including the State of AI Delivery ZA 26 campaign pages and the survey reached from them. By using the site you agree to them. If you do not, please do not use the site.
The site is operated by DayOne Builds (Pty) Ltd, registration number 2026/316994/07 (DayOne, we, us).
Separate terms apply elsewhere: the members' portal at portal.dayone.build has its own terms, and any paid engagement with DayOne is governed by its own written agreement. Nothing on this site varies either of those.
Using this website
You may read this site, and use its forms for their obvious purpose. That is the whole of the licence we grant you.
You may not scrape, harvest or systematically extract the site or its contents, including the profiles in the Humans directory. You may not attempt to identify any individual listed on this site, or to match a listing to a named person. You may not use the site or its forms to send unlawful, misleading or abusive content, to impersonate anyone, to submit a brief you have no intention of pursuing, or to probe, disrupt or circumvent the site's security.
We may restrict or withdraw access where any of the above happens.
Enquiries and briefs
Sending an enquiry, a brief or a booking through this site does not create a contract or an engagement, and does not oblige us to take the work. Any engagement follows a separate written agreement.
Do not send us confidential information through a website form. If a brief needs to be confidential, say so and we will put something in place before you send the detail.
Taking part in the State of AI Delivery survey
Participation is voluntary and free. There is no obligation to answer, and no consequence if you do not. The prize draw is separate and optional, and is governed by the Competition Rules.
By submitting the survey you confirm that your answers are your own, that you are answering honestly and in good faith, and that you are entitled to share whatever you have chosen to disclose about the organisation you work for. Do not put your employer's confidential information into a survey answer.
We may exclude a response from the findings, without telling you, where it appears to be duplicated, automated, deliberately false, or submitted to distort the result. A national survey is only worth reading if we do.
We may close the survey at any time.
The report and its findings
The report, and the analysis, commentary, charts and design in it, belong to DayOne.
You may quote from the published report, and reproduce individual figures from it, provided you attribute it to DayOne's The State of AI Delivery ZA 26 and do not alter the meaning of what you quote. You may not republish the report as a whole, put it behind your own paywall, or present its findings as your own research.
The findings describe what respondents told us. They are a snapshot of a self-selecting sample at a point in time, not a statistically representative study of the South African market, and not professional advice. Do not make an investment, hiring or strategic decision on the strength of the report alone. We publish the methodology and the sample size with it so that you can judge what weight it deserves.
Our survey partners
The survey is supported by OfferZen, Pepperplane, Velocity Labs and Altron AI Factory, with The Open Letter as media partner. Sponsors receive only anonymised, aggregated results, as set out in the Privacy Policy.
Those partners are independent businesses. Their logos appear on this site to credit their support of the survey. Their support does not mean we endorse them, that they endorse our findings, or that we are responsible for anything they do, say or publish.
No partner has editorial control over the report. The findings as published are ours.
The Humans directory
The people listed on this site are members of the DayOne network, listed by initials and without contact details. Enquiries about a member come to us, and we approach the member. There is no mechanism on this site for contacting a member directly, and attempting to work around that is a breach of these terms.
A listing describes how a member prefers to work and when they say they are available. It is not a warranty by us as to their skills, their conduct or their availability on any particular date.
Intellectual property
The DayOne name, logo, the design of this site, its photography and its written content belong to DayOne or to the people who licensed them to us. You may not copy, adapt or reuse them beyond what these terms allow or the law permits.
Third-party names and logos on this site, including those of our survey partners, belong to their owners and appear with permission.
Other sites and services we link to
This site links to services run by other people, including the survey on Typeform and our booking page on Google Calendar. Once you follow such a link you are on someone else's service, subject to their terms and their privacy notice, and we are not responsible for how they operate or what they do with what you give them.
Availability, and what we do not promise
The site is provided as it is and as it is available. We do not promise it will be uninterrupted or error free, and we may change, suspend or remove any part of it, including the campaign pages and the survey, at any time.
We take care to keep the content of this site accurate, but we do not warrant that it is complete or current, and the report carries the specific caveats set out above.
Nothing in these terms excludes any liability that cannot lawfully be excluded, and nothing in them affects your rights under POPIA or the Consumer Protection Act.
Governing law
These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them or from your use of this site.
